1. Introduction
Winehouse Real Estate (Licence No. 4956473) is a Gold Coast real estate agency providing residential sales, property management and leasing services. We take the privacy of the people we deal with seriously, and we are bound by the Australian Privacy Principles set out in the Privacy Act 1988 (Cth).
This policy explains what personal information we collect, why we collect it, who we share it with and how we look after it. Read it alongside any terms that apply to your use of this website. By using this website, or by giving us your personal information, you agree that we may collect, use and disclose it in the ways described here.
In this policy, the Act means the Privacy Act 1988 (Cth) as amended from time to time, and personal information has the meaning given to it in the Act. Broadly, it means any information or opinion about you from which you can reasonably be identified. We, us and our mean Winehouse Real Estate.
2. What we collect
We only collect personal information where we need it to carry out our work. What we collect depends on the nature of your dealings with us, and may include:
- your name and contact details, such as email address, phone number and residential or postal address;
- where you are entering into a contract, a tenancy or another transaction with us, or applying to work with us, information that identifies you and supports the transaction. That can include date of birth, government-issued identification, previous addresses, employment details, income, references and bank or payment details;
- household details, such as the number of people who will occupy a property and their ages;
- a record of your communications and dealings with us;
- your property preferences, search history, enquiries and buying or renting intentions;
- information about your visit to this website, including your IP address, approximate location, the pages you view and the links you follow;
- information that is publicly available, including information published online; and
- any other information reasonably needed to complete your dealings with us.
We also collect information that does not identify anyone, such as aggregated website statistics and anonymous survey responses.
3. How we collect it
Wherever possible we collect personal information directly from you. That usually happens when you:
- contact us by phone, email, social media or through a form on this website;
- request an appraisal, a rental appraisal or information about a property;
- attend an open home, an inspection or an event we host;
- submit a tenancy application or make an offer on a property;
- subscribe to our updates, or enter a promotion or survey we run; or
- leave a review or comment on our website, Google Business Profile or social media pages.
Sometimes we collect personal information about you from third parties, including:
- property portals and platforms such as realestate.com.au and Domain, where you have submitted an enquiry;
- our property management platform and other software we use to run the agency;
- tenancy databases, referees, previous agents and previous or current employers, where you have applied for a tenancy;
- your solicitor, conveyancer, accountant, broker or other representative;
- government agencies, regulators and law enforcement, where the law allows or requires it; and
- another agency or agent, where an existing relationship or database is transferred to us.
If you apply for a position with us, we may also collect your work history, qualifications and the results of relevant record checks from you, from recruiters and from your referees. This policy does not apply to employee records of our current and former employees, which are exempt under the Act.
4. Why we collect it
We collect, hold, use and disclose personal information to run our business and deliver our services. That includes:
- providing the services or information you have asked us for;
- appraising, marketing, selling, leasing and managing property;
- assessing tenancy applications and managing tenancies, including rent, maintenance and inspections;
- answering your enquiries and responding to feedback or complaints;
- letting you know about properties, market updates and services that may interest you;
- improving and securing this website and understanding how it is used;
- working with the contractors and service providers who support our business;
- keeping the records we are required to keep as a licensed agency;
- meeting our legal obligations and enforcing our agreements; and
- considering an application to work with us.
You can deal with us anonymously or under a pseudonym in some situations, such as a general enquiry. In most cases, though, if you choose not to give us the information we ask for, we may not be able to provide the service you want.
5. Who we share it with
We will not disclose your personal information other than as set out in this policy, with your consent, or where we are permitted or required to do so by law.
We may share your information with the parties who help us run the agency and complete your transaction, including:
- technology providers, including our trust accounting, property management, CRM, email, cloud storage and website hosting suppliers;
- marketing, advertising, photography, styling, copywriting, signage and printing suppliers;
- property portals and listing platforms where a property is advertised;
- solicitors, conveyancers, accountants, brokers, valuers, building and pest inspectors and other professional advisers;
- trades and contractors engaged to quote for or carry out maintenance;
- tenancy databases, insurers, body corporate managers and utility connection services;
- a landlord, a vendor, a purchaser or a tenant, where sharing the information is necessary to complete the transaction;
- a party acquiring all or part of our business or assets;
- anyone you have authorised us to share your information with; and
- government agencies, regulators, courts and law enforcement, where the law allows or requires it.
6. Disclosure overseas
Some of the software and data storage providers we rely on hold information on servers outside Australia. Where we disclose your personal information to a provider located overseas, we take reasonable steps to make sure it is handled in a way that is consistent with the Act.
7. Direct marketing
We may send you market updates, property alerts and information about our services by email, SMS, post, phone or social media, in line with the Act and the Spam Act 2003 (Cth).
You can opt out at any time. Use the unsubscribe link in any email or SMS we send, or email info@winehouserealestate.com and we will remove you from our marketing lists.
8. How we protect your information
We hold personal information electronically and, in some cases, in hard copy. We take reasonable steps to protect it from misuse, interference, loss and unauthorised access, including:
- password-protected and access-controlled systems;
- reputable suppliers who meet appropriate security standards;
- secure storage of any hard-copy records held at our office;
- confidentiality obligations on our people and our contractors; and
- secure destruction or de-identification of information we no longer need to keep.
No system is completely secure, and information sent over the internet is never entirely risk free. Any personal information you send us online is transmitted at your own risk.
9. Cookies and website analytics
